Chhattisgarh High Court Declares NEET PG Admission Rules “Unconstitutional”: What It Means for Students

The Chhattisgarh High Court has struck down NEET PG 2025 admission Rules 11(a) and 11(b), terming them discriminatory and unconstitutional. PG medical admissions in Chhattisgarh will now be conducted strictly on a merit basis. Read the full story.

Raipur: The Chhattisgarh High Court has delivered a landmark judgment by striking down two key provisions of the Chhattisgarh Medical Post Graduate Admission Rules, 2025. These rules Rule 11(a) and Rule 11(b) granted preference to MBBS graduates from within the state and to domicile candidates.

The court ruled these provisions “discriminatory, unconstitutional, and violative of Article 14”, making it clear that NEET PG 2025 admissions must be based purely on merit.

Why the High Court Struck Down the Rules

The court observed that postgraduate medical education requires high academic standards, and any form of institutional or domicile preference dilutes merit.
The verdict highlighted that:

  • MBBS location cannot determine eligibility for PG medical seats
  • Domicile-based preference for PG medical courses is not allowed
  • Merit in NEET PG must be the primary selection criteria

This ruling came after a candidate challenged the rules for violating the constitutional right to equality.

What Were Rules 11(a) and 11(b)?

Rule 11(a)

Gave first priority to candidates who completed MBBS inside Chhattisgarh.

Rule 11(b)

Gave second priority to candidates who studied MBBS outside the state but belong to Chhattisgarh (domicile).

The court found both provisions unfair and arbitrary, creating an artificial advantage for certain students.

Impact on NEET PG 2025 Aspirants

This judgment directly affects medical aspirants applying for Chhattisgarh state-quota PG medical seats.

Equal chance for all NEET PG qualifiers

Candidates from any state, or those who studied MBBS elsewhere, can compete fairly.

Aligned with Supreme Court rulings

The decision follows earlier national-level judgments against domicile or institutional preference for PG medical courses.

Why This Judgment Is Important

  • Ensures fairness and transparency in NEET PG counselling
  • Protects the merit-based admission system at the PG level
  • Promotes national mobility of medical students
  • Prevents restrictive policies that limit opportunities for deserving candidates

The High Court emphasized that India needs well-trained specialists, and this is only possible when merit not location determines admissions.

What Happens Next?

Chhattisgarh authorities must now:

  • Update the NEET PG 2025 counselling rules
  • Remove domicile/institutional preference
  • Conduct admissions strictly based on NEET PG rank and eligibility
