A Punjab-based NEET PG 2025 aspirant has approached the Bombay High Court after being denied admission to postgraduate medical courses in Maharashtra’s private unaided medical colleges. The candidate completed her MBBS degree outside Maharashtra, due to which she was declared ineligible for state-quota PG seats.
Why Was Admission Denied?
As per Maharashtra’s existing PG admission rules, candidates who studied MBBS outside the state are not considered for state-quota seats in private unaided medical colleges unless they completed MBBS through an All India Quota or under specific permitted categories. The petitioner argues that this rule is unfair and restricts opportunities for students who belong to Maharashtra but pursued MBBS elsewhere due to availability, affordability, or other reasons.

Court’s Previous Stand on Similar Cases
In earlier judgments, the Bombay High Court upheld the admission policy that allows only those domicile candidates who completed MBBS outside Maharashtra through All India Quota or government/central institutions to be eligible for state-quota PG seats. The court considered this a merit-based filtering system and allowed flexibility for policymakers to address the needs of the state and maintain fairness in seat allocation.
Recently, the High Court also permitted private medical colleges to conduct college-level counselling to fill vacant seats, reinforcing the state’s right to create procedures to ensure seats do not remain empty.
